Declarations of Interest

Members to indicate whether they will be declaring any interests under the Code of Conduct.

 

Members making a declaration of interest at a meeting of a Committee or Council are required to disclose the existence and nature of that interest.  This requirement is not discharged by merely declaring a personal interest without further explanation.

The Chair gave an overview of the Hearing Procedure and explained that there was no application for the exclusion of the public.

To determine an application for a Premises Licence from Mr Roddy Hamilton for The Private Hill, Thrussendale Farm, Thrussendale Road, Acklam, YO17 9RG

The Licensing Sub-Committee considered a report of the Environmental Health Manager:

 

The Sub-Committee have had sight of: The Report of the Licensing Officer and each of the 24 written representations submitted by Interested Parties. 

 

RESOLVED That the Licence be granted for the following activities:

 

 

A.   The supply of alcohol both on and off the premises between the hours of 1200hrs and 2200hrs each day.

 

B.   Premises open to the public 1000hrs to 1900hrs each day.

 

C.   The Licensed Premise will be the site referred to as Jane’s Dome including the decking surrounding Jane’s Dome – this will be clearly defined on a plan.

 

The members of the Sub-Committee have listened carefully to all that has been said to them during the hearing, by the Applicant and all of the Interested Parties who made verbal representations to them.  Members have also had the opportunity to read the all of the Sub-Committee papers which included 24 individual representations from interested parties. Members are grateful to everyone who has attended.

 

The members of the Sub-Committee wish to note that whilst they have listened carefully to what has been said to them;  members are unable to take into account the following matters when determining this application;

 

The Planning Consent for the site,

General matters of farm Health and Safety,

General matters relating to the public highway leading to the site.

 

These matters are subject to separate legislation and regulation outside of the provisions of Licensing Act 2003.

 

Members have heard however that the site has four pods each of which can accommodate up to 4 individuals.  The fifth pod, Jane’s dome operates as a café, it is intended that the café will be able to serve walkers, cyclists and any other locals  or visitors during more restricted hours  of 1000hrs and 1600hrs 

 

 

The sub-committee are of the view that;

 

There is nothing they have heard within the evidence presented to them which suggests that the Licensing Objectives have not been promoted by the Application and therefore would lead them to not grant the application as revised by the Applicant prior to the Hearing.
