Urgent Business To receive notice of any urgent business which the Chairman considers should be dealt with at the meeting as a matter of urgency by virtue of Section 100B(4)(b) of the Local Government Act 1972. Minutes: There was one item of urgent business in relation to the enforcement case on Land at Cornborough Road Sheriff Hutton. The special circumstances were that the outcome of the case was not known before the despatch of the agenda for the Planning Committee meeting and accordingly the case was not on the agenda. It was also considered important for the Planning Committee to be made aware of the Crown Court case without delay. |

Minutes: 16/01317/MFUL - Erection of 4no. pairs of three bedroom semi-detached dwellings and 2no. pairs of two bedroom semi-detached dwellings (12no. dwellings in total) together with parking, amenity areas, landscaping and formation of vehicular access.
Decision
PERMISSION GRANTED - Subject to a Section 106 Agreement relating to the provision of affordable housing and subject to the recommended conditions. Note: details of the rate of surface water discharge condition to be delegated to the Head of Planning & Housing in consultation with the Foss Internal Drainage Board and Lead Local Flood Authority.

The hearing for the case was at York Crown Court on Friday 8 November 2016 and was in relation to the prosecution of Lena Banks for failure to comply with enforcement notices relating to failure to remove a cabin used for residential purposes and failure to comply with a condition about the design of a barn. The enforcement notices were served in respect of breaches of planning control on Land at Cornborough Road Sheriff Hutton.
Lena Banks pleaded guilty to three charges and was convicted with a 12 month conditional charge. She was ordered to pay the Council's costs of £1050. |
